Railroad and Transportation
GSRM advises publicly and privately owned Class I, Class II and shortline railroads throughout Tennessee and the United States. Our attorneys understand how common carriers operate and how to navigate through the intricacies of federal and state laws that apply to railroads. Our attorneys’ experience in high profile rail cases provides clients with the knowledge required to surmount the complexities presented by this unique type of litigation. In addition, our attorneys are actively involved in the National Association of Railroad Trial Counsel, and are frequently called upon to present seminars on railroad litigation topics.
GSRM’s experience in the law—coupled with a full understanding of the real world issues faced by railroad organizations—allow our attorneys to provide solutions to serious problems. Our attorneys represent railroads in federal and state court claims, including representation on Federal Employers Liability Act matters, as well as Railway Labor Act and Federal Railroad Safety Act claims. The firm has experience in a variety of substantive law issues, including:
- Emergency response and accident investigations
- Wrongful death and catastrophic injury
- Cancer, brain damage and other injuries alleged caused by chemical exposure
- OSHA whistleblower claims
- Labor and employment suits
- Railroad right-of-way and property issues, including premises liability and trespasser incidents
- Insurance coverage problems
- Environmental, energy and utilities
Our attorneys work in partnership with in-house counsel and risk managers to vigorously defend against some of the most aggressive plaintiff attorneys in the country. GSRM has successfully defended lawsuits where single, multi and class action plaintiffs have sought significant compensatory and punitive damages.
Because construction plays a major role in railroad expansion, GSRM works diligently with clients to overcome obstacles related to expansion and development initiatives. Our attorneys assist clients to obtain approval for new rail lines and advise them on all matters relating to railroad property laws and rights. While the extent and derivation of railroad rights-of-way are a mystery to many attorneys, the firm has extensive knowledge and experience dealing with them. In addition, our litigators offer the requisite experience required to handle federal preemption and eminent domain disputes that can arise in the creation of new rail lines. GSRM also represents railroads in property rights disputes throughout Tennessee, including class action defense.
GSRM provides transportation law counsel to trucking companies and motor carriers, as well as shippers and equipment manufacturers that utilize transportation services. Our attorneys represent clients in matters that range from the transportation of hazardous materials, to contract negotiation and defense pertaining to vendor/supply, inter-carrier, track abandonment and line relocation agreements. The firm’s lawyers have appeared before the Surface Transportation Board, U.S. Department of Transportation and National Transportation Safety Board, among others. GSRM’s experience also includes representing bus companies in highway accident defense.
The transportation industry is people intensive—so GSRM works to provide practical employment law solutions and defense to owners, managers and supervisors. The firm’s experience in employment law includes employment contracts and handbooks, training programs and employee discipline, wrongful discharge, harassment, discrimination and wage/hour claims.
