Overview

Rhea Bucy practices in the areas of bankruptcy and commercial law, litigation and general business counseling.  His experience includes corporate reorganizations, avoidance actions and other adversary litigation and contested matters, receivership proceedings in state and federal court, and the purchase and sale of assets in and out of bankruptcy.  In bankruptcy cases, he represents business debtors (both individuals and entities), secured and unsecured creditors, lessors, creditors’ committees, purchasers of assets, and trustees in reorganization and liquidation bankruptcies.

In addition to work in bankruptcy cases, Rhea negotiates and documents out-of-court or informal workouts and debt compositions.  He works with clients to analyze and implement alternatives to bankruptcy, which can result in cost savings and can be a better way, in a particular matter, to preserve assets and continue the client’s commercial viability.  Rhea has assisted in renegotiating bank loans and covenants, revising debt instruments and working out vendor payment plans, as well as in restructuring his clients’ businesses.  He has participated in successful mediations in bankruptcy and commercial cases.

Rhea’s experience also includes prosecuting and defending litigation arising in bankruptcy cases.  He has resolved contested matters pertaining to plan confirmation, claims and debtor in possession financing, as well as litigated adversary proceedings, including appeals.  He also advises clients on structuring settlements and evaluating third-party claims.  In bankruptcy cases, he deals with numerous areas of non-bankruptcy law including real estate, the Uniform Commercial Code, franchise, state tax, domestic relations, trust, tort, landlord-tenant and banking.

Rhea has represented clients from such diverse industries as retail, manufacturing, technology, distribution, agribusiness, food processing, automotive and transportation, entertainment and hospitality, real estate and healthcare, among others.

Rhea served as Managing Partner of Gullett Sanford Robinson & Martin PLLC from 1994 to 1999.  He and his wife, a professor of history, are the parents of two grown children.
